The Site
The FlightBox Shop (hereinafter referred to as the “Site”) is an e-commerce site accessible via the Internet at https://byblooom.co. It is open to all users of this network (hereinafter referred to as “Internet users”). It is published by Myceliums, a Société par Action Simplifiée Unipersonnelle (simplified joint stock company) whose registered office is located at 34 rue Servan 75011 Paris, France, and which is registered with the Paris Trade and Companies Registry under number 841 845 142 00014. The Site enables Myceliums to offer toiletry kits containing cosmetics and perfumes (hereinafter referred to as the “Products”) for sale to Internet users browsing the Site (hereinafter referred to as “Users”).
The Site allows the Products assembled by the FlightBox brand to be ordered immediately online via the Internet for delivery to FRANCE and internationally. For the purposes of this Agreement, it is agreed that the User and FlightBox shall be collectively referred to as the “Parties” and individually referred to as the “Party”, and that the User who has validated an order shall be referred to as the “Buyer”. The rights and obligations of the User shall necessarily apply to the Buyer. It is specified that the Products are intended for the personal use of the User, without any direct connection with the User’s professional activity. The User who wishes to purchase on the Site declares that he/she has full legal capacity. Any order for a Product offered on the Site implies consultation and express acceptance of these general terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the User. In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, taken for the application of Article 1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation of the order form as specified in Article 3.3. below, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
The purpose of the present general terms of sale is to define, exclusively on the basis of the relations established on the Internet network and solely on the Site, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site from France. They determine all the steps necessary to complete an order and ensure the follow-up of this order between the parties.
FlightBox may at any time update these terms and conditions of sale.
The present conditions apply to the exclusion of any other document.
Products
The Products offered for sale by FlightBox are those which appear on the Site on the day the User consults the Site. The photographs illustrating the Products are not part of the contract. If they are inaccurate, FlightBox shall not be held responsible.
The Products are offered within the limits of available stocks. In case of unavailability of one of the Products, the Buyer will be informed as soon as possible. In the event that the unavailability of a product is noted after the validation of the order, the Buyer will have the possibility, within thirty (30) days at the latest after their collection, to cancel his order by requesting either the reimbursement of the sums paid, or to exchange the unavailable Product(s), by e-mail sent to smile@flightbox.fr.
FlightBox shall not be liable for any shortage of stock or unavailability of products.
Price – Payment
The prices of the Products are indicated in euros. They take into account the V.A.T. applicable on the day of the order. The prices indicated do not take into account packaging and delivery costs which will be charged in addition and will be specified to the User during the final validation of his/her order.
FlightBox reserves the right, which the User accepts, to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is registered, subject to the availability of the Products.
It is specified that all payments will be made immediately on the Internet. Unless the server is unavailable, the User may validate his/her order by credit card (Blue, Visa, Mastercard). The user will enter his card number, the expiry date, the name of the cardholder and the visual cryptogram. Payment by card is secured by SSL Secure Shopping technology
How to order
The Site allows you to order FlightBox Products immediately online via the Internet for delivery to France or abroad.
Orders paid by credit card are prepared the same day (working days) if they are registered before 3 pm, otherwise the next working day. Orders are then sent by the usual postal services, and in particular by means of the “Colissimo” service under which the Post Office undertakes to deliver within 48 hours. In any case, the order will be executed at the latest within thirty (30) days from the day following the validation of the order by the User.
The Products ordered by the Buyer will be delivered to the address indicated by the latter on the order form or left at the post office of the delivery address mentioned by the Buyer, in case of absence of the recipient of the Products, or left at the selected Point Relais if this choice is made by the Buyer.
FlightBox therefore declines all responsibility in the event of excessive delivery time due to the postal services, as well as in the event of loss of the Products ordered or a postal service strike. It is specified that the risks of transport are borne by the Buyer. In the event of a delay in delivery, the Buyer must report this delay as soon as possible to FlightBox’s customer service, by e-mail to smile@flightbox.fr, or by post to Myceliums, 34 rue Servan 75011 Paris. FlightBox will then contact the postal services so that an investigation can be carried out. The time required for a postal investigation may be long.
Furthermore, it is specified that the property of the ordered Products will only be transferred to the Buyer upon full payment of the invoiced price, including delivery costs. Upon receipt of the ordered Products, the Buyer must check the conformity of these Products. Any anomaly concerning the delivery (missing or broken Product, damaged parcel, …) must be reported by the Buyer on the receipt presented by the Post Office when the parcel is delivered and must imperatively be notified to FlightBox’s customer service by e-mail to smile@flightbox.fr or by post to Myceliums, 34 rue Servan 75011 Paris. Any claim made after 14 days will be rejected and FlightBox will be released from any responsibility.
FlightBox will not be responsible for any loss, wrong address or delay in delivery of a product, as the risks of the transport that the Buyer chooses rest on him/her.
Right of withdrawal
The Buyer has a period of fourteen (14) working days to return, at his/her own expense, the Product(s) he/she has ordered if he/she is not satisfied with them. This period runs from the day of delivery of the order. The Product(s) shall be returned in its (their) original packaging and condition, accompanied by the stub at the bottom of the invoice or delivery note, to the following address ESAT Bastille Façonnage FlightBox 29 Rue du Faubourg Saint Antoine, 75011 Paris FRANCE.
If the above conditions are met, FlightBox will reimburse the Buyer, within thirty (30) days, the sums corresponding to the products acquired by him/her. FlightBox does not accept packages with postage due.
Any risk related to the return of the product(s) is the responsibility of the Consumer.
It is however specified that the shipping costs are at the charge of FlightBox in the case where the decision to return is the consequence of an error emanating from FlightBox (non-conforming Product(s)).
Personal Information
The personal information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Failure to provide this information will result in automatic rejection of the order. In accordance with the French Data Protection Act, the processing of personal information collected on the Site has been declared to the French National Commission for Data Protection. The User has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the User should send a simple letter to the FlightBox consumer service – 34 rue Servan 75011 Paris or an e-mail to smile@flightbox.fr.
Cookies
The Site makes use of cookies. A cookie is a computer file stored on the hard disk of the User’s computer. Its purpose is to indicate a previous visit by the User to the Site. Cookies are only used by FlightBox in order to personalise the service offered to the User. It cannot, under any circumstances, damage the data on the computer.
Most browsers automatically accept cookies, but they can also be configured not to accept them or to indicate when cookies are being sent. We recommend that you do not deactivate this function, as this would prevent you from moving freely from page to page and benefiting from all the specific features of the Site.
Force majeure
Neither Party shall be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure. Events meeting the criteria set out in the case law of the 2nd civil chamber of the Court of Cassation shall be considered as force majeure. The Party invoking an event constituting force majeure shall notify the other Party within five working days of the occurrence or threat of such event. The Parties agree that they shall consult each other as soon as possible in order to determine together the terms and conditions for the execution of the order for the duration of the force majeure event.
After a period of one (1) month of interruption due to force majeure, FlightBox may not honour the order, and shall reimburse the Buyer if necessary.
Partial invalidity
If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope.
Entire contract
The present general conditions of sale and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties. In the event of contradiction between these documents, the general conditions of sale shall prevail.
Applicable law – Jurisdiction
The sale of products by Myceliums is subject to French law, regardless of the country of residence of the Buyer and the place where the Order is placed.
ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, PERFORMANCE OR BREACH OF CONTRACT BETWEEN FLIGHTBOX AND THE BUYER, EVEN IN THE EVENT OF MULTIPLE DEFENDANTS, SHALL, IN THE ABSENCE OF AN AMICABLE AGREEMENT, BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COMPETENT FRENCH COURTS IN ACCORDANCE WITH THE RULES LAID DOWN BY THE FRENCH CODE OF CIVIL PROCEDURE.
